Called Off Road To Cover Yard When Extra Board is Exhausted
(RULE 32K)

SCENARIO #1:
  • If there are no rested yardmen available for the vacancies:
  • Your entire yard shift is to be paid at time and a half

SCENARIO #2:
If it not concrete that the switchmen’s extra board was exhausted, and/or that no other yardmen were willing to step up, 

  1. Per the above mentioned PLB, you are entitled to be made-whole for the difference in what the job you would have worked paid
  2. If a pool trip, this would be the entire round trip minus the meal allowance.
  3. In this instance the switchman who should have been called would also be entitled to a basic day mishandling claim.

Required Documentation: 

  • A copy of your payroll recap showing declination number (mandatory)
  • Your call sheet (very important for this claim), and extra board snapshots.

    EXAMPLE SCENARIO #1:
    ​
    Was called off the (circ 7)____ (board)____ to work the ( yard job circ-7, board, and job ID)____ on (date)____ @ (time)____ hrs. The (circ-7 and switchman's extra board ID)____ (switchmen’s extra board)____ was exhausted with no rested men available at calling time. I was on duty @ (time)____ hrs, tied-up at (time)____ hrs on (date)____ . Claim entire shift at time and a half (3/16ths daily yard rate) as per Rule 32K and Public Law Board No. 164, Case # 186, Award #186.

    EXAMPLE SCENARIO #2:
    ​
    Was called off the (circ 7)____ (board)____ to work the ( yard job circ-7, board, and job ID)____ on (date)____ @ (time) hrs.  Switchman (Initial and Last Name)____ was rested and available at calling time on the (circ-7 and switchman's extra board ID)____ and should have been called for this assignment. Conductor ______was directly behind me on the (Road Extra Board ID)____ board. Had I not been illegally called to cover the yard, I would have worked the (Train ID)____ to (Circ-7)____ and the (Train ID)____ back to (Circ-7)____. Conductor ­­­­­­­______ instead worked these trips and made a total of (Dollar Amount)____ round trip, not including meal allowances. I instead made (Dollar amount)____ working the (Yard Job ID)____. I claim the make-whole payment of (Dollar Amount)____ as per Rule 32K and PLB 164, Case # 186, Award #186.
